TERMS & CONDITIONS

 

TERMS:  All Custom Chenille merchandise is shipped FOB Custom Chenille's plant in Dallas, Texas.  At the time merchandise is delivered to UPS, FedEx, other delivery service or common carrier, title transfers to the Customer. 

 

CREDIT TERMS:  For customers on open credit, payment terms are net 10 days from invoice date.  Credit applications are available on our website at www.chenille.com.  Visa, Master Card, American Express and Discover cards are gladly accepted.  Until credit is approved, customers must prepay by credit card or check. 

 

PRICES:  Prices are subject to change without notice.  Prices on the Order Acknowledgement and written quotes are the only prices honored.

 

SALES TAX:  All orders shipped to locations within the state of Texas will include sales tax (current rate is 8.25%) unless a tax exemption certificate is on file.

 

STANDARD LEAD-TIME:  The standard lead-time is approximately 20 business days from the date customer approves art or sample. Standard orders during peak demand may require longer lead-time. Preferred Partner chenille orders are shipped in 15 business days or less, regardless of season.

 

ORDER MINIMUMS:  Minimum order quantity of 6 pieces (same style, same color, same size). Preferred Partners are exempt from order minimums.

 

VOLUME DISCOUNTS:  Discounts are available for larger quantities. Call (214) 343-0888 or (800) 227-2040 for a quote.

 

SHIPPING:  Orders will be shipped FOB Dallas, Texas.  Unless otherwise specified by the customer, the order will ship UPS ground.  Shipping, insurance and handling charges are the responsibility of the customer and are not included in the quote or price, and will be added to the invoice.

 

CUSTOM DESIGNS:  Art preparation/setup for custom designs begins at $50.00 and varies based on size and complexity of the design.  Art preparation/setup files remain the property of Custom Chenille.  Quotes are available upon receipt of artwork and other necessary information.  Call Customer Service at 214-343-0888 or 800-227-2040 for details.

 

WARRANTY:  All Custom Chenille products are warranted against defective workmanship or materials.  Custom Chenille reserves the right to examine merchandise to determine, in its sole discretion, if the merchandise is defective due to workmanship or materials.

 

RETURN OF MERCHANDISE:  Claims for defective merchandise must be made within two weeks after receipt of the merchandise.  No merchandise will be accepted by Custom Chenille without a Return Merchandise Authorization (RMA) number.  To obtain an RMA number, please call (800) 227-2040.  The RMA number must appear on the outside of all boxes returned.  Merchandise returned without an RMA number will be returned to the customer at the customer's expense.

 

CHANGES & CANCELLATIONS:  Emblems are “made to order” and therefore not returnable.  Changes and/or cancellations must be made prior to the first step in producing the order.  Otherwise, the order will be subject to full charges.

 

CUSTOMER SUPPLIED MATERIALS:  There is a 2% spoilage allowance on all customer-supplied garments and materials.

 

RUSH SERVICE:  Rush orders will be accepted when production capacity allows.  A 25% premium is assessed to the order amount for orders shipped in 10 business days, a 50% premium is assessed for orders shipped in 5 business days, and a 100% premium is assessed for 24-hour service.  The minimum rush service premium is $25.00.

 

CUSTOM CHENILLE IMAGE:  Reproduction of Custom Chenille images, including catalogs, web site, and sales literature, is prohibited by copyright protection, without Custom Chenille's prior written consent.

 

PLACING ORDERS:  To place an order, complete an order form and fax it to (214) 349-8884, e-mail it to your Custom Chenille Salesperson, or mail it to Custom Chenille.  Please call (214) 343-0888 or (800) 227-2040 with questions and comments.  Completed orders received before 2:00 pm Central Time are dated the day received.  Orders received after 2:00 pm are dated the next business day.  Orders with new artwork are dated upon approval of the artwork.

 

EMBLEM MEASUREMENTS:  A chenille emblem is measured in inches from chenille edge to chenille edge not including the felt.  Standard tackle twill lettering is measured in inches and is based on the height of the top color of the most prominent letter.

 

TRADEMARKS:  Written permission is required from the trademark owner prior to production of emblems with protected logos and designs.  Custom Chenille will not be responsible for copyright or trademark infringement by the buyer.
